1. Acceptance of Terms & Eligibility
By completing checkout for The Vitality Path, you confirm that:
- You are at least 18 years of age;
- You have the legal capacity to enter into this agreement;
- The information you provide at signup is accurate and current; and
- You have read, understood, and agree to be bound by these Terms.
2. Description of Services
The Vitality Path is a personalized wellness coaching program. Services may include, without limitation: guided consistency and accountability check-ins, personalized wellness planning, nutrition and exercise guidance, and confidence/mindset coaching, delivered via scheduled calls, written materials, and other communication as arranged with your coach.
The Vitality Path is educational and motivational coaching. It is not medical care. See Section 6 (Health & Medical Disclaimer) for important limitations.
3. Subscription, Billing & Payment
3.1 Subscription Fee
The Vitality Path is billed on a recurring monthly basis (the "Subscription Fee"), at the rate confirmed at checkout, charged automatically to the payment method on file at the start of each monthly billing cycle, beginning on your enrollment date.
3.2 Automatic Renewal
Your subscription renews automatically each month unless you cancel in accordance with Section 4. You authorize POREIA (via our payment processor, Stripe) to charge your payment method on file for each renewal period until cancellation is effective.
3.3 Price Changes
POREIA reserves the right to change the Subscription Fee for future billing cycles. We will provide at least 30 days' advance notice by email before any price change takes effect. Continued use of the service after a price change takes effect constitutes acceptance of the new price.
3.4 Failed Payments
If a payment fails, we may retry the charge and/or suspend access to coaching services until payment is resolved. Repeated failed payments may result in cancellation of your subscription.
4. Cancellation Policy
You may request to cancel your subscription at any time by emailing alive@joinporeia.com. From the date of your request, cancellation follows a 30-day process during which POREIA will make a genuine effort to help: first exploring whether adjusting your plan or focus addresses what isn't working, then offering a complimentary month so you can experience that adjustment before deciding for good.
This outreach is offered in good faith and is entirely optional — it does not obligate you to remain enrolled, and you may proceed directly to cancellation at any point if you'd prefer.
Cancellation takes effect at the end of the 30-day period, or the end of your current billing cycle, whichever is later. You will retain full access to coaching services through that time. No further charges will be made once cancellation is finalized.
5. Refund Policy
All Subscription Fees are non-refundable, including for partial months, unused sessions, or early cancellation. By enrolling, you acknowledge and agree that no refunds — full or prorated — will be issued once a billing cycle has been charged.
This no-refund policy does not limit any rights you may have under applicable consumer protection law that cannot be waived by agreement.
6. Health & Medical Disclaimer
The Vitality Path is coaching, guidance, and encouragement — it is not medical treatment, diagnosis, therapy, or a substitute for professional medical or mental health care.
- Your coach is not a licensed physician, dietitian, or mental health professional unless separately and explicitly identified as such.
- Always consult a qualified healthcare provider before beginning any new exercise, nutrition, or wellness program, especially if you have any pre-existing medical condition.
- If you experience a medical emergency, call 911 (or your local emergency number) immediately — do not rely on POREIA or your coach for emergency care.
- Any recommendations provided are general guidance only and are not personalized medical advice.
7. Assumption of Risk & Limitation of Liability
Participation in any fitness, nutrition, or wellness activity carries inherent risk. By enrolling in The Vitality Path, you voluntarily assume all risks associated with your participation.
To the fullest extent permitted by law, POREIA, its owners, coaches, and affiliates shall not be liable for any injury, loss, or damage arising from your participation in or reliance on The Vitality Path program, except to the extent caused by our gross negligence or willful misconduct. In no event shall POREIA's total liability to you exceed the amount you paid to POREIA in the three (3) months preceding the claim.
8. Client Responsibilities
You agree to:
- Provide accurate health, contact, and payment information;
- Communicate honestly with your coach about your goals, limitations, and any changes in your health status;
- Use good judgment and stop any activity that causes pain or discomfort; and
- Treat your coach and any POREIA staff with respect and courtesy.
9. Scheduling, Rescheduling & No-Shows
Coaching calls should be rescheduled with at least 24 hours' notice by contacting alive@joinporeia.com. Repeated late cancellations or no-shows may reduce the coaching attention available to you within your subscription but will not entitle you to a refund or credit under Section 5.
10. Confidentiality & Privacy
Information you share with your coach will be treated as confidential and used only to support your coaching experience, except where disclosure is required by law or necessary to prevent harm to yourself or others. Payment information is processed directly by Stripe, our third-party payment processor, and is not stored by POREIA.
11. Intellectual Property
All materials provided as part of The Vitality Path — including written guidance, plans, and program content — are the property of POREIA and are licensed to you for personal use only. You may not reproduce, resell, or distribute this material without written permission.
12. Termination by POREIA
POREIA reserves the right to suspend or terminate your access to The Vitality Path, without refund, if you violate these Terms, engage in abusive conduct toward staff, or if continued participation poses a safety concern.
13. Changes to These Terms
POREIA may update these Terms from time to time. Material changes will be communicated by email at least 14 days before taking effect. Continued use of The Vitality Path after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, and any disputes shall be resolved in the state or federal courts located in Texas.
